The Higher Court in Podgorica has decided to release businessmen Ranko Ubović and Vladan Ivanović from custody, a move that has sparked significant legal discussions. The court’s ruling follows a hearing conducted by the Special State Prosecutor’s Office (SDT), which had previously suggested that the detention of the two individuals was illegal.
Defense attorney Nikola Ivanović expressed his surprise regarding the SDT’s announcement, emphasizing that the court’s decision was both legitimate and lawful. He noted that the SDT’s assertion about the illegality of the detention contradicts established legal practices in similar cases.
In a statement, Ivanović highlighted, “I believe there was no justification for the detention of these individuals, nor should their incarceration have been a consideration in this matter.” He firmly stated that he does not see any reasonable suspicion that they committed a criminal offense, particularly not the one they are accused of.
The SDT’s assertion that the detention was unlawful has raised questions about the procedural aspects of the case. Ivanović refrained from making further comments on the SDT’s statement, maintaining that the court’s decision stands as fully justified and legal. He indicated that the case could undergo further scrutiny if the SDT decides to appeal the ruling.
“It remains to be seen what opinions higher instances will have regarding this,” Ivanović remarked, pointing out that the law allows for such possibilities. This ongoing legal saga underlines the complexities surrounding the judicial process in Montenegro and highlights the potential for further developments as the case progresses.
The situation places a spotlight on the balance of legal authority and the rights of individuals within the justice system. Observers will be keen to follow any forthcoming actions by the SDT and the implications for the businessmen involved.
