North Tyneside Man Jailed for 12 Months After Restraining Order Breach

UPDATE: Daniel Lumsden, a 37-year-old man from North Tyneside, has been sentenced to 12 months in prison for breaching a restraining order after approaching his ex-girlfriend on the street. This urgent development comes just days after Lumsden was confirmed to have violated the court’s order, which prohibited any contact with the victim following a violent attack in 2023.

The Newcastle Crown Court heard that Lumsden’s history of violence led to a suspended sentence last year, along with an indefinite restraining order. During the brutal incident, Lumsden attacked the woman unprovoked, subjecting her to severe physical harm and psychological trauma. The attack occurred on the evening of May 9, when the victim, accompanied by her child, encountered Lumsden while visiting a local shop in Annitsford.

Witnesses reported that Lumsden approached the victim, shouting and invading her personal space. The court was informed that he had a total of 38 previous convictions for 71 offences, with many linked to violence.

During the sentencing, Prosecutor Jordan Parkinson detailed the harrowing events of their past relationship, which lasted for only 10 months before ending in violence. Lumsden’s violent behavior culminated in an incident where he demanded the victim’s phone, physically assaulted her, and left her seriously injured.

Defence attorney Spencer Downey argued that this was a “low-level breach” and claimed it was merely a chance encounter. However, Judge Gavin Doig emphasized the seriousness of Lumsden’s actions, stating that the breach of the restraining order represented a significant disregard for the law designed to protect the victim.

The court concluded that, despite Lumsden’s mental health issues, he must face the consequences of his actions. Judge Doig remarked that while Lumsden may not have deliberately sought out the victim, his behavior was unacceptable and posed a threat to her safety.

This case highlights the urgent need for protective measures for victims of domestic violence, as the repercussions of such breaches can be devastating. The emotional toll on survivors remains a critical issue, and this ruling serves as a reminder of the judicial system’s commitment to enforcing restraining orders to protect vulnerable individuals.

As this story develops, it underscores the importance of awareness surrounding domestic violence and the legal protections in place for victims. Readers are encouraged to stay tuned for further updates on this case and others like it.
